What Are Trusts?

A trust is a way of providing control of property by a trustee for the use and benefit of a beneficiary. A "testamentary trust" is a trust that is contained in a person's will and goes into effect at the person's death. The will names a trustee who will take control over certain assets and distribute them over time to the designated beneficiaries.

There are also trusts that go into effect during a person's lifetime usually known as "living trusts" or "revocable trusts." Revocable trusts are not for everyone. We talk with our clients about their options so that they can decide whether one of these trusts fits their needs.
